I played Batcave on the build phase which would then give me back the initiative at the start of the combat phase.

but my brother then uses his Silver Surfer's effect which at the start of the combat phases lets him gain the initiative.

who would be the one to end up with the initiative?

When multiple triggered effects trigger the primary player adds their effects to the chain first and then the opponent's effects are added. During a step (i.e. Recruit step, Attack step, etc) the player who's step it is, is the primary player. Outside of a step, the player who has initiative is the primary player (i.e. start of Combat Phase). So, since your brother had the initiative when the combat phase began, Silver Surfer's effect would be added to the chain first. Then, your Batcave's effect would be added to the chain. They would then resolve from top to bottom. Thus, your brother would retain initiative.

i will explain with further detail to make sure you  are understanding, it is my initiative but with Batcave i gave him the initiative for the build phase, but the effect also states that at the start of the combat phase i  get the initiative, but when the "start of the combat phase" he then uses his silver surfer's effect which states at the start of the combat phase he must discard a fantastic four character and he will gain the initiative. so since i used my effect first shouldn't my effect be the first on the chain?  

It does not matter that your effect originates from an older card. That only applies when you both have competing ongoing effects. At the start of the combat phase, two effects are triggering, Batcave and Silver Surfer. Your opponent still has the initiative, since Batcave's effect has not resolved yet. You have not gained the initiative back yet. Since your opponent has the initiative, and you are not in a step, he has priority. His effects are added to the chain first and then your's. Again, Batcave resolves, giving you the intiative and then Silver Surfer resolves giving your opponent back the initiative.

ok...then since technically its his initiative would he be able to use his effect. Because if it is his initiative, his effect wouldn't work cause he already has it so he can't really gain it?

Silver Surfer does not say that you have to not have the initiative for his effect to trigger. Even if his controller has the initiative his effect will trigger. Most of the time there is not point to discard the card, however, and players just skip it.

ok...another question the 7 drop Azrael says i am considered to control batman, the means i have to control batman in order for him to be recruited?

In order for the card to work the way you fear it does, it would have to have this wording:

"Recruit [this character] only if you control [different character]"

Edit: The reason the card in question has the text "you are considered to control Batman" is so that things that reference controlling the character Batman [such as DOR-020 Superman, DCL-037 Bat Computer and DWF-201 Brains and Brawn] can be done with Azrael, since in this card he has taken up the mantle as Batman [like how Bucky is the new Captain America].

He can also be searched for with DBM-006 Commissioner Gordon since the word 'Batman' is in the text of the card.

omg thx i always that i needed batman in order to recruit him so i never got the card.....
